Terms of Service.

By creating an account, completing your user profile, submitting referral links, claiming partner opportunities, earning point rewards, or accessing any portion of SideWinn, you represent that you have read, understood, and agree to be bound by these Terms and our integrated Privacy Policy, Cookie Policy, Safety Guidelines, and Earnings Disclaimer.

SideWinn reserves the right to modify or update these Terms at any time. Notice of significant amendments will be communicated via banner notification on the dashboard or by email. Your continued use of the platform following published changes constitutes explicit acceptance of the revised Terms.

To register an account and maintain access to SideWinn, you must fulfill the following mandatory eligibility criteria:

• Minimum Age Requirement: You must be at least 18 years of age (or the legal age of majority in your jurisdiction). Date of birth provided during profile completion is verified to enforce age compliance.
• One Account Per Individual: Each individual user is permitted to create and maintain exactly one account. Multi-accounting, account sharing, or registering proxy accounts is strictly prohibited.
• Unique E.164 Phone Verification: Account creation and profile completion require registering a valid mobile phone number formatted in E.164 standard format (e.g. +919876543210). SideWinn enforces database-level UNIQUE constraints (idx_profiles_unique_phone_e164). If a phone number is already linked to an existing account, registration or update will be rejected with: "This phone number is already linked to another SideWinn account."
• Accurate Profile Information: You agree to provide true, accurate, and current profile metadata including display name, city, occupation, and payout details. Providing fraudulent metadata constitutes grounds for account termination.

SideWinn enables community members to upload third-party product referral links to participate in referral link distribution:

• Warranty of Lawful Ownership: By submitting a referral link URL, you represent and warrant that you are the primary account holder of the underlying merchant account (e.g. Swiggy, Zomato, Amazon Pay, Google Play, GitHub, etc.) and authorized to share the link.
• Prohibited Links: You must not upload broken links, malicious URLs, phishing domains, links containing malware/spyware, affiliate links from prohibited networks, or links containing deceptive redirects.
• Attribution Engine: Uploaded links are validated via save_user_referral_link RPC and served via our round-robin attribution engine. Successfully uploading a valid referral link awards +10 points to your immutable points balance. Each verified successful referral generated through your link awards an additional +2 points.
• Merchant Terms Compliance: You acknowledge that third-party merchants may have their own referral program guidelines. SideWinn is not responsible if a third-party merchant modifies, cancels, or refuses to honor a referral reward due to third-party policy changes.

SideWinn features curated opportunities categorized as referral, gig, deal, drop, cashback, and reward:

• Claim Process: Clicking "Start Opportunity" initializes an active task claim recorded in tasks with status "In Progress". You must complete all listed requirements and steps before submitting proof.
• Distribution Modes: Opportunities operate under defined capacity rules:
  • OPEN: Available continuously to eligible users.
  • WAVE: Released in periodic batched waves.
  • LIMITED_SLOTS: Capped at a maximum number of total claims.
• Referral Gate & Paid Access: Certain high-value or paid opportunity tiers may require uploading a valid referral link or completing foundational tasks before unlocking claims.

To verify completion of a claim, users must upload authentic completion proof:

• Authentic Proof Required: Proof submissions must consist of genuine, unedited screenshots, verification URLs, or Transaction IDs confirming task fulfillment. Submitting altered screenshots, Photoshop edits, stock imagery, or third-party proof constitutes severe fraud.
• Review Statuses: Proof submissions transition through under_review, approved, resubmit, or rejected.
• Admin Moderation & Permanent Rejection: SideWinn administrators utilize stored procedures (approve_proof, reject_proof, reject_proof_permanently) to audit proof validity. Permanently rejected proof submissions forfeit all reward claims for that task.
• Point Allocation: Successfully verified opportunity completions automatically award +30 points to your account balance via award_points RPC.

SideWinn features a transactional gamification framework stored exclusively in PostgreSQL (user_points, points_history, user_streaks):

User earnings from cash deals, referral rewards, and verified cashback accumulate in your platform wallet:

• Pending vs. Wallet Balances: Pending rewards represent unverified claims awaiting admin or merchant validation. Only verified balance in "Wallet" is eligible for withdrawal request.
• Payout Channels: Withdrawals may be executed via configured payout methods in payout_methods (Bank UPI, Digital Gift Cards, USDC/BTC Crypto transfers).
• Verification & Processing Windows: Payout requests undergo standard verification taking 24 to 72 business hours. SideWinn reserves the right to hold or cancel payout requests if fraud, self-referral, or system manipulation is detected.
• Tax Responsibilities: Users are solely responsible for reporting income and fulfilling tax obligations under Indian Tax laws (including Income Tax and TDS requirements).

SideWinn and its original code, design tokens, logos, playbooks, custom components, and brand identity are the exclusive intellectual property of SideWinn.

SideWinn provides users complete autonomy over their data while retaining administrative moderation capabilities:

• Self-Service Account Deletion: You may permanently delete your account at any time via Settings > Account > Danger Zone. Clicking "Delete Account" opens a 2-step verification modal requiring typing DELETE in all caps. Confirming execution calls the delete_user_account stored procedure, transactionally wiping your profile, active tasks, proof uploads, referral links, points ledger, streaks, saved wins, reviews, and auth records.
• Administrative Suspension: SideWinn administrators reserve the right to suspend or terminate accounts that breach these Terms, upload fraudulent proof, or abuse platform systems.

SIDEWINN IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. SIDEWINN DOES NOT GUARANTEE THAT OPPORTUNITIES, CASHBACK OFFERS, REFERRAL REWARDS, OR THIRD-PARTY DEALS WILL BE ERROR-FREE, CONTINUOUSLY AVAILABLE, OR HONORED BY MERCHANTS.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SIDEWINN, ITS DIRECTORS, OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOSS OF PROFITS, DATA, OR GOODWILL RESULTING FROM YOUR ACCESS TO OR USE OF THE PLATFORM.

These Terms shall be governed by and construed in accordance with the laws of the Republic of India, without regard to its conflict of law principles.

Any dispute, controversy, or claim arising out of or relating to these Terms, or the breach, termination, or invalidity thereof, shall be submitted to the exclusive jurisdiction of the competent courts located in New Delhi / Bengaluru, India.
